Terms of Service
BESS SERVICE Terms of Use
Version date: 7 September 2026 Applicable website: https://bessservice.eu/
1. Agreement and Operator
These Terms form an agreement between you and Energy Planet Services B.V., the operator of the BESS SERVICE brand (“we”, “us” or “our”), concerning access to or use of the BESS SERVICE website and related online services. These include accounts, Academy courses, assessments, certificates, the technician network, project matching, case studies and BESS ProVision demonstrations.
Please read these Terms, our Privacy Policy and our Cookie Policy before registering, enrolling, submitting an application or using the relevant services. If you act on behalf of an organisation, you must have authority to accept these Terms on its behalf.
Operator: Energy Planet Services B.V. Registered office: Walborg 2-A, 1082 AM Amsterdam, the Netherlands Dutch Chamber of Commerce (KvK) number: 42109239 Business contact address: Keienbergweg 17, 1101 EZ Amsterdam, the Netherlands Contact email: service@bessservice.eu
2. Scope of Services
The website provides or describes BESS installation support, commissioning, inspection, operation and maintenance, troubleshooting, component replacement, Factory Acceptance Testing (FAT) support, Long-Term Service Agreements (LTSA), technical training, and BESS ProVision 3D visualisation and digital-twin solutions. It may also provide a technician network, project-opportunity matching, courses, assessments, certificates, newsletters and business enquiry functions.
Website descriptions do not constitute a project quotation or an unconditional service commitment. The scope, fees, delivery, acceptance and responsibilities for field services, training, sourcing, BESS ProVision development and other commercial projects are governed by separately agreed quotations, statements of work or contracts.
3. Eligibility and Accounts
Accounts, training certification and project-matching services are primarily intended for industry professionals aged 18 or over. You must provide accurate, complete and current information, including your company, contact details, qualifications and experience.
You must protect your password and verification codes and must not share, sell, impersonate or transfer accounts without authorisation. Contact us promptly if you discover unauthorised access or a security risk.
4. Academy, Assessments and Certificates
Academy courses support general professional training and knowledge development. They do not replace applicable law, manufacturer requirements, site induction, professional licences, electrical qualifications, HSE training or employer competence assessments. Users must not rely solely on a course or certificate to perform high-risk work beyond their competence or authorisation.
A completion record or certificate only confirms that the account holder completed a stated course or passed a platform assessment at a stated time. It is not a government licence, statutory professional qualification, manufacturer certification, employment guarantee or guarantee of project allocation.
Users must personally complete assessments where required and must not impersonate others or cheat. We may investigate and, where appropriate, revoke results or certificates obtained through false information, cheating or technical abuse.
5. Technician Network and Project Matching
Joining the technician network or completing training does not guarantee work, projects, income, visas, insurance or an exclusive relationship. Invitations depend on client needs, location, qualifications, experience, availability, safety requirements and further verification.
Unless separately agreed, registration, training, certification or matching does not itself create employment, agency, partnership or a joint venture between you and us. Each field assignment must separately establish its scope, engagement status, remuneration, tax, insurance, safety requirements and responsibilities.
If you opt into project matching, we may provide necessary professional information to relevant clients or project partners in accordance with our Privacy Policy. You must ensure that your CV, qualifications, work authorisations and experience statements are accurate and valid.
6. Technical Content, Case Studies and Safety
Courses, case studies, videos, diagrams, checklists, parameters and other materials provide general information and training. They are not engineering, safety, legal or investment advice for a specific installation or project.
Field work must follow approved project documents, manufacturer manuals, risk assessments, method statements, local requirements and instructions from the responsible site authority.
Some case images or scenes may be anonymised, edited or illustrated to protect client confidentiality. Unless expressly stated, displaying a case study does not imply endorsement by the relevant client.
7. BESS ProVision and 3D Demo
BESS ProVision models, animations and interactive demonstrations support product presentation, technical communication and training. Structures, dimensions, movements, parameters and environments may be simplified and must not replace approved engineering drawings, installation documents or site operating procedures.
Unless otherwise agreed in writing, users receive only a limited, non-exclusive and non-transferable licence to view and use demonstrations normally. Without permission, users must not copy content, download source models, remove rights notices or use demonstrations for competing products, except where applicable law provides otherwise.
8. User Submissions
You may submit profiles, CVs, certificates, company information, project materials, attachments or feedback. You retain your existing rights and authorise us to use such content as necessary to review submissions, provide services, communicate, perform matching and maintain required records.
You must ensure that submissions are accurate, lawful and properly authorised. Do not upload client-confidential material, third-party personal information, site-sensitive information or other restricted content without authorisation.
9. Acceptable Use
You must not use the website to publish unlawful, fraudulent, harassing or infringing material; falsify identity, qualifications, certificates or project experience; upload malware; attack, disrupt or bypass security measures; scrape data at scale or create a competing database without permission; distribute restricted courses; or send spam or marketing without required consent.
10. Intellectual Property
Except for user content and identified third-party material, the website design, courses, videos, assessment questions, certificate designs, databases, software, 3D models, trademarks and logos are owned or lawfully used by us or our licensors. They must not be copied, adapted, sold, publicly distributed or extracted at scale without written permission, except as permitted by applicable law.
11.Third-Party Services and Links
The website may link to or integrate video, social media, maps, authentication, email and other third-party services. These services are governed by their own terms and privacy notices. We do not control third-party content, availability or independent data-processing activities.
12. Suspension, Termination and Account Closure
You may stop using the website and request account closure. We may restrict, suspend or terminate accounts or services for unlawful conduct, fraud, cheating, false qualifications, certificate misuse, security risks or material breach, and may revoke certificates or matching eligibility where appropriate.
Where legally permitted and consistent with security investigations, we will provide reasonable notice and a channel for feedback. Personal data following account closure will be handled in accordance with our Privacy Policy.
13. Disclaimers and Limitation of Liability
The website is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, suitability of a course for a particular role, competence for field work merely through course completion, any project opportunity, or applicability of general information to all equipment and sites.
To the extent permitted by applicable law, we are not liable for indirect or consequential loss, loss of profit, lost business opportunities or business interruption. These Terms do not exclude or restrict liability that cannot lawfully be excluded or restricted, including fraud, wilful misconduct, gross negligence and non-excludable personal injury liability.
14. Governing Law and Disputes
These Terms are governed by Dutch law. Subject to mandatory legal requirements, disputes will be submitted to the competent courts of Amsterdam. Consumers retain the protection of mandatory consumer laws applicable in their country of habitual residence.
15. Changes and Contact
We may update these Terms for business, technical or legal reasons and will indicate the updated date. Material changes will be reasonably notified through the website, account notices or email. The invalidity of any provision does not affect the remaining provisions.
